- Applicability
These general terms and conditions apply to every offer from Vitaminalia and to every agreement concluded between Vitaminalia and the consumer.
- Offer
All dietary supplements are clearly and truthfully depicted and/or described, but are only provided for informational purposes without any commitment. Each offer contains sufficient information so that it is clear to the consumer what rights and obligations are associated with accepting the offer.
- Prices and Payments
The prices of products listed include VAT. Shipping costs are clearly communicated at the time of ordering. Payment can be made through the methods offered by Vitaminalia. Invoices are payable in cash, no later than 14 days after the invoice date, to the bank account of Vitaminalia bv.
- Delivery
Vitaminalia aims to deliver orders within 5 working days. However, the buyer cannot rely on a delay in delivery to cancel the order or demand any compensation. If there is a delay in delivery, the consumer will be notified as soon as possible. The buyer agrees to accept partial deliveries.
- Right of Withdrawal
The consumer has the right to withdraw from the agreement within 14 days, without giving any reason. After withdrawal, you have an additional 14 days to return the unopened products. You will then be credited the full order amount including shipping costs. Only the costs for returning the goods from your home to our warehouse are at your own expense. The return address is: Vitaminalia bv, Broekstraat 78A, 9220 Hamme, Belgium To exercise your right of withdrawal, you can send an email to [email protected] indicating the return shipment and providing your bank details. You will receive the amount owed within 14 days after we have received the goods back in good order. The consumer will handle the product and packaging carefully during the cooling-off period. Opened packages cannot be returned or refunded.
- Complaints Procedure
Complaints about the performance of the agreement must be submitted to Vitaminalia in writing within 10 working days, clearly and fully described, by registered mail. Once this period has elapsed, there is an irrefutable presumption that the goods have been accepted. If the complaints are justified, Vitaminalia bv will, at its own discretion, either pay compensation of up to the invoice amount of the protested goods, or replace these protested goods. Our liability is limited to replacement of the quantity of defective goods or the invoiced amount. Under no circumstances will we be liable for consequential damages.
- Privacy Policy
Personal data are treated confidentially and not disclosed to third parties, in accordance with our privacy policy and in compliance with applicable law.
- Additional or Deviating Provisions
Additional provisions or provisions deviating from these general terms and conditions may not be to the detriment of the consumer and must be recorded in writing.
- Applicable Law
Any dispute between the parties will be brought before the Courts of Dendermonde, which are exclusively competent. Belgian law will apply. However, the seller (we) may also bring legal action before the Court of the debtor’s domicile.
